In an almost four week trial, Ardent’s lead trial attorney, Hubert Kuo, obtained decision where the judge rendered a full rescission of an immigration investment agreement for his client. The damages inclusive of prejudgment interest, would amount to be about $1.2 million dollars.
At the conclusion of the trial, the Court found that Ardent’s lawyers were able to obtain rescission based on unilateral mistake and they were also able to prove breach of fiduciary duty. Shortly before the decision was rendered, Mr. Kuo also successfully argued an appeal brought by the defendants before the 4th District Court of Appeal which affirmed the lower court’s granting of a preliminary injunction freezing Defendants’ assets. Mr. Kuo was assisted by Ardent’s attorney David Yu during trial.
